DEFINITIONS AND INTERPRETATION
‘The Sussex Garden School’ (and ‘We’, ‘Our’, ‘Ours’ and ‘Us’) refers to JS Garden Studios Ltd Trading As: The Sussex Garden School.
‘Site’ means www.sussexgardenschool.com
‘Terms and Conditions’ means these terms and conditions
‘Tickets’ means printed, electronic of the right to an Event sold by Us to You.
‘Voucher(s)’ Sussex Garden School gift voucher or e-voucher
‘You’ means you or anybody who in our reasonable opinion is acting with your authority or permission. ‘Your’ shall be read accordingly.
Terms and Conditions of Gift vouchers and E-Vouchers
Sussex Garden School Gift Vouchers and E-vouchers are valid for the purchase of courses and talks run by The Sussex Garden School and merchandise sold by The Sussex Garden School.
Vouchers cannot be exchanged for cash or replaced if lost, stolen or damaged.
Gift Vouchers and E-vouchers have an expiry date 1 year from the date of purchase. Expired Gift Vouchers and E-vouchers cannot be exchanged, replaced or have their expiry date extended.
Any purchases are subject to payment card verification.
You have the right to cancel your purchase of Gift Voucher or E-vouchers within 14 days of purchase.
If you do cancel your Voucher within such 14 day period, you will receive a full refund upon receipt of your returned Gift Voucher provided that The Sussex Garden School shall be entitled to deduct from such refund the amount of the Gift Voucher used or redeemed prior to the cancellation date. The Sussex Garden School also reserves the right to deduct a reasonable administration fee.
If the entire Gift Voucher has been used or redeemed you will not receive a refund. If you do want to cancel and You are eligible to do so, you should email info@julietsargeant.com
It is your responsibility to check your voucher, as mistakes cannot always be rectified after purchase. Please check your voucher on receipt carefully and contact us immediately if there is a mistake.
Your Vouchers will be delivered as an E-Voucher code to the email address provided when you registered on the website.
Please check your ‘junk folder’ if you do not receive your Voucher.
You can redeem your E-voucher by entering the code into the online purchase form on The Sussex Garden School website.
Any duplicate Voucher issued by The Sussex Garden School, will render the original E-Voucher null and void.
If the amount you pay for a Voucher is incorrect regardless of whether because of an error in a price posted on the site or otherwise communicated to you, then we will have the right to cancel that Voucher (or the order for that Voucher) and refund to you the amount that you paid. This will apply regardless of whether because of human error or a transactional malfunction of this website.

Terms & Conditions of Short Courses, Talks & Workshops
Booking and Enrolment
Places on a course are only secured on receipt of full payment, with booking via our website. Any purchases are subject to payment card verification.
Where a concession is claimed, proof of identity and concession entitlement may be required.
All concessions and discounts are subject to availability, they may be restricted to certain price levels and can be withdrawn by The Sussex Garden School without notice.
Only one concession or discount is available per ticket.
It is your responsibility to check your ticket(s) as mistakes cannot always be rectified after purchase. Please check your ticket(s) on receipt carefully and contact us immediately if there is a mistake.
We will not be responsible for any ticket that is lost, stolen or destroyed.
It is not always possible to issue duplicates and doing so may incur a reasonable administration fee.
Please notify us of any access requirements at the time of booking.
Please notify us of any dietary requirements (if relevant to the event) at the time of booking.
Prior to booking, The Sussex Garden School reserves the right to amend prices in the event of any alterations to VAT.
Prior to booking, The Sussex Garden School reserves the right to alter the timings, tutor, price or content of any course.
If the amount you pay for a ticket is incorrect regardless of whether because of an error in a price posted on the site or otherwise communicated to you, or you are able to order a ticket before its scheduled on-sale or pre-sale date or you are able to order a ticket that was not supposed to have been released for sale, then we will have the right to cancel that ticket (or the order for that ticket) and refund to you the amount that you paid. This will apply regardless of whether because of human error or a transactional malfunction of this website.
Confirmation
You will receive an email confirmation of your online booking. Pre-course/event information will usually be sent by email in advance including information on anything that you may need to bring. Please be aware that email communications may be filtered into your ‘junk folder’. it is your responsibility to check your junk folder for communications from The Sussex Garden School prior to the event that you have booked.
Cancellations by You
For cancellations made six weeks or more in advance of the course date, we offer one free date change, with a 20% administration charge. If a date change has been requested and confirmed, we cannot offer any further refunds or date changes on a subsequent cancellation for the same booking.
If we receive less than six weeks’ notice, we are unable to offer a refund or date change.
If a discount has been applied to the ticket(s), then this will only be honoured within the original terms and conditions of the offer.
Clothing & Equipment
Please wear clothing suitable for a workshop environment and for outdoor activities. Some events may require specific Personal Protective Equipment to be worn and, or other equipment to be brought by you. You will be advised of this prior to the start of the event.
Safety Briefing
All courses begin with a detailed safety briefing and all students are asked to sign a form confirming they have listened to, and understood, the briefing. For the safety of yourself and others, Sussex Garden School tutors may need to exclude people who do not comply with safety instructions. Should this be the case, no fees will be refunded.
Coursework/Materials
Courses are inclusive of basic materials and safety equipment. All items produced on the course by students are theirs to keep. Some courses necessitate either collection or postage of the finished items at a later date. Details are included with each course description and postage costs may be incurred.
Alteration, Cancellation and Postponement by Us
The Sussex Garden School reserves the right to postpone, or cancel the date of courses should it become necessary and for whatever reason. Students will be notified as soon as possible and alternative dates will be arranged or a full refund given.
We endeavour to run our events in inclement weather. However, where an outdoor event is cancelled or curtailed because of adverse weather, we shall not be liable to make any refund or pay any compensation. The Sussex Garden School reserves the right to alter the tutor or content of any course (where it does not, in our opinion, constitute a material change to the course subject) in response to matters beyond our control.
A ‘material’ change to the programme of the event is a change which, in our reasonable opinion, makes the event materially different to the event that purchasers of the ticket, taken generally, could reasonably expect. The use of an alternative tutor does not represent a material change.
It is your responsibility to ascertain whether an event has been cancelled or re-scheduled and the date and time of any re-scheduled event. Where an event is cancelled or re-scheduled, we will use our reasonable endeavours to notify you using the details you provided us with at the time of ordering. We do not guarantee that You will be informed of such cancellation before the date of the event.
It is your responsibility to inform us of any change to the contact address, telephone number or email address you provide us with at the time of ordering.
Where such a refund is sought due to cancellation, rescheduling or a material change to the programme of the event, you must bring this to our attention as soon as possible upon becoming aware of such material change, cancellation or where the event has been rescheduled, prior to the rescheduled event. The refund for ticket(s) equals the price paid by you to us for such ticket minus a reasonable administration fee.
Refunds shall only be made to the person who purchased the tickets.
Course Admission
The Sussex Garden School reserves the right to refuse to admit any person who in our opinion is not in a condition to safely undertake the course. We also reserve the right to terminate a course, or exclude an individual, for any improper or unacceptable behaviour. Should this be the case, no fees will be refunded.
Photography
The Sussex Garden School reserves the right to use on our website, or for publicity purposes, any photographs we might take during a course, including those of course participants. Students may take photographs during the course where safety permits. Please inform the tutor if you prefer not to be photographed.
Force Majeure
Obligations under these Terms are suspended for the period that the Force Majeure Event continues, and The Sussex Garden School will extend the time to perform these obligations for the duration of that period. Reasonable steps will be taken to bring the Force Majeure Event to a close or to find a solution by which our obligations under these Terms can be performed despite the Force Majeure Event.
A Force Majeure Event includes any act, event, non-occurrence, omission or accident beyond our reasonable control and includes, in particular (without limitation), the following:
- (a) strikes, lock-outs or other industrial action; or
- (b) civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war; or
- (c) fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster; or
- (d) impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport; or
- (e) impossibility of the use of public or private telecommunications networks.
Liability
Students must not bring any items of special value onto the premises of The Sussex Garden School. The Sussex Garden School will not accept responsibility for the loss of any personal possessions.
The Sussex Garden School will not be liable for any loss suffered by students which is indirect, special or consequential or comprises loss of profits.
The Sussex Garden School will not be liable for any loss suffered by a student resulting from any event which is beyond the reasonable control of The Sussex Garden School.
Personal arrangements including travel, accommodation or hospitality relating to the event which have been arranged by you are at your own risk. Unless otherwise stated in our Terms and Conditions, our liability to you in connection with the event (including, but not limited to, in the event of cancellation, rescheduling or material change to the programme of the event) shall be limited to the ticket price paid by you.
We will not be responsible for any loss, injury or damage to any person (including you) or property howsoever caused (including by us):
(a) in any circumstances where there is no breach of a legal duty of care owed by us;
(b)in circumstances where such loss or damage is not a reasonably foreseeable result of any such breach (save for death or personal injury resulting from our negligence);
(c) to the extent that any increase in any loss or damage results from breach by you of any of these Terms and Conditions.
Nothing in these Terms and Conditions seeks to exclude or limit our liability for death or personal injury caused by our (as relevant) negligence, fraud or other type of liability which cannot by law be excluded or limited.
Intellectual Property Rights
The copyright, design right and all other intellectual property rights in any materials and other documents or items that The Sussex Garden School prepares or produces for the student in connection with the services provided, will belong to The Sussex Garden School absolutely.
The student may not use the materials, documents or other items provided by The Sussex Garden School for any commercial purpose.
The Sussex Garden School reserves the right to copy or display any student’s work generated whilst they attended the course for the purpose of education and/or promotion.
Data Protection
The Sussex Garden School will only use the personal information you provide to us to provide the services, or to inform you about similar services which we provide, unless you tell us that you do not want to receive this information
General
No failure or delay by The Sussex Garden School in enforcing any of its rights under the contract shall be deemed to be a waiver of such right. The contract shall be governed by English law.
These Terms and Conditions do not and shall not affect your statutory rights as a consumer.
After Sales and Complaints

Waiver
If we delay or fail to enforce any of these Terms and Conditions it shall not mean that we have waived our right to do so.
Assignment
We shall be entitled to assign any of our rights and obligations under these Terms and Conditions provided that your rights are not adversely affected.
Severability
If it is found by a court that any of these Terms and Conditions for any reason cannot be enforced, this shall not prevent the other provisions from continuing to apply.
Third Parties
Any person who is not a party to these Terms and Conditions shall have no rights to rely on any of these Terms and Conditions.
